Terms of Service
These Terms reflect the current WeightGainer design. Mandatory consumer rights and other applicable law prevail where they cannot be waived.
1. Agreement
By accessing or using WeightGainer, you agree to these Terms, the Privacy Policy, Refund Policy, AI Content Policy, and applicable commercial disclosures. If you do not agree, do not use the service.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into a binding agreement. You are responsible for maintaining control of your sign-in method and for activity performed through your account. You may not share, sell, automate access to, or misuse another person's account.
3. Service description
WeightGainer is an AI-assisted image transformation service. It accepts an uploaded image and attempts to create a synthetic, multi-stage body-weight progression while preserving other visible characteristics where possible. Results are generated probabilistically and may differ materially from the requested outcome.
4. Rights in uploaded material
You may upload only material that you own or are otherwise authorized to use for AI-based editing. If an identifiable person appears in an upload, you are responsible for obtaining any consent or other legal basis required for that use. You grant WeightGainer and its service providers a limited, non-exclusive right to process the material solely as needed to operate, secure, troubleshoot, and provide the requested service.
5. Prohibited use
You must not use WeightGainer for unlawful conduct; harassment; blackmail; fraud; impersonation; deceptive identity manipulation; non-consensual intimate or exploitative content; sexualization of minors; infringement of privacy, publicity, copyright, or other rights; circumvention of technical safeguards; automated abuse; payment fraud; malware; or any activity prohibited by applicable law or by the policies of our infrastructure, AI, authentication, or payment providers. We may block, suspend, or terminate access where we reasonably believe misuse has occurred.
6. Credits and generation charges
Credits are prepaid units usable only within WeightGainer. They are non-transferable and have no cash redemption value except where applicable law requires otherwise. A generation normally costs one credit. The application reserves a credit when generation begins and is designed to return that credit when generation fails before successful completion. A generation that successfully completes and produces a retrievable output may consume the credit even if you later dislike the result.
For live purchases, purchased Credits expire 150 days after the applicable purchase date. The applicable expiration date is shown before purchase and in the account experience. Credits that expire unused are not refundable except where applicable law requires otherwise.
7. Payments
Payments are processed by PayPal or another payment processor shown at checkout. You authorize the processor to charge the amount displayed. Taxes, exchange rates, bank fees, or processor charges may apply depending on your location and payment method. You must not initiate abusive, fraudulent, or duplicate chargebacks. Refund eligibility is governed by the Refund Policy and mandatory consumer law.
8. AI outputs and no outcome guarantee
Outputs are synthetic and may contain visual errors, identity drift, anatomical errors, artifacts, or unexpected changes. WeightGainer does not guarantee similarity, realism, accuracy, uniqueness, fitness for a particular purpose, or that an output will meet subjective expectations. Outputs are not medical advice, health predictions, factual statements, or reliable representations of a person's future appearance.
9. Temporary result storage
Generated results may be stored temporarily in Cloudflare R2 for recovery, currently for up to approximately 24 hours, subject to technical deletion timing. Results may also be stored locally in your browser. Temporary storage is provided for convenience and is not a backup service. You are responsible for downloading any output you wish to retain.
10. Service availability and changes
We may modify, restrict, suspend, discontinue, or replace features, pricing, models, providers, limits, retention periods, or the service itself. Availability may be affected by third-party providers, maintenance, abuse prevention, legal requirements, capacity limits, or failures outside our control.
11. Intellectual property
WeightGainer's software, branding, interface, and original service materials are protected by applicable intellectual-property laws. Your rights in uploaded material remain yours, subject to the limited processing permission above. Rights in AI-generated outputs may vary by jurisdiction and are not guaranteed by these Terms.
12. Suspension and termination
We may suspend or terminate access for violations of these Terms, suspected fraud or abuse, security risk, non-payment, chargeback abuse, legal obligations, or conduct that threatens the service or other users. Where practical, we may provide notice, but immediate action may be taken when necessary.
13. Disclaimer of warranties
To the maximum extent permitted by law, the service is provided "as is" and "as available" without warranties of uninterrupted operation, error-free output, merchantability, fitness for a particular purpose, non-infringement, or compatibility with any device or workflow. Nothing in these Terms excludes warranties that cannot legally be excluded.
14. Limitation of liability
To the maximum extent permitted by law, WeightGainer and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, loss of business, reputational harm, or claims arising from reliance on generated content. Where liability cannot be excluded, aggregate liability will be limited to the greater of the amount you paid to WeightGainer during the three months preceding the event giving rise to the claim or the minimum amount required by applicable law.
15. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold the operator harmless from third-party claims arising from your uploaded material, your misuse of the service, your violation of another person's rights, or your breach of these Terms.
16. Mandatory consumer rights
These Terms do not limit rights that cannot be waived under applicable consumer-protection law. If a provision conflicts with mandatory law applicable to you, that law controls to the extent of the conflict.
17. Governing law and disputes
These Terms are intended to be governed by Japanese law, without excluding mandatory consumer protections that apply based on the user's place of residence.
18. Changes to these Terms
We may update these Terms as the service changes. Material changes will be reflected by updating the effective date and, where required, by providing additional notice. Continued use after an effective update constitutes acceptance where permitted by law.
19. Operator and contact
WeightGainer operator information required by Japanese commercial law is available through the commercial disclosure. Requests for legally required operator name, address, or telephone information may be sent before purchase to softsignal3band@gmail.com, and will be handled without undue delay in accordance with applicable law.
